FAIRFAX, Va. — The National Rifle Association’s Institute for Legislative Action (NRA-ILA) applauds Gov. Kristi Noem for signing HB 1296, a law that ensures the law-abiding gun owners of South Dakota won’t be disarmed during natural disasters or emergencies, such as the outbreak of COVID-19.

“With law enforcement and state resources stretched incredibly thin, it’s more important than ever for authorities to recognize every law-abiding American’s right to self-defense and to keep and bear arms,” said Brian Gosch, NRA South Dakota state director. “The people of South Dakota are safer today with Gov. Noem’s signature on HB 1296.”

Passed on the final day of the South Dakota legislative session, HB 1296 declares that no state agency, political subdivision, or any elected or appointed official or employee may prohibit, regulate, or curtail the otherwise lawful possession, carrying, sale, transportation, transfer, defensive use, or other lawful use of any firearm or ammunition.

The law also protects indoor and outdoor ranges and prohibits firearm confiscation, revocation or suspension of carry permits, the refusal to accept carry permit applications, mandated gun store closures, or a limitation on the number of firearms or ammunition purchases.

The five million members of the NRA thank Gov. Noem for securing this right for every law-abiding South Dakota gun owner,” concluded Gosch.

The law goes into effect immediately.
